Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Standing Senate Subcommittee on
Higher Education was held on Monday, March 31, 2003, in the
Betty King Committee Hearing Room, 2E.20, at Austin, Texas.

The chair called the meeting to order at 4:05 p.m. There being
a quorum present, the following business was transacted:
Senator Janek moved adoption of the minutes from the previous
hearing held on March 24, 2003; without objection, it was so
ordered.
There was no action taken for the following bill(s): SB 337
The chair laid out SB 111 and recognized the author, Senator
Barrientos, to explain the bill. Senator Van de Putte sent up a
committee substitute; the chair recognized Senator Barrientos to
explain the difference between the committee substitute and the
bill as filed. Witnesses testifying and registering on the bill
are shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator West moved that SB 111 be left pending to await a
quorum; without objection, it was so ordered.
The chair laid out SB 415 and recognized the author, Senator
Carona, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator West moved that SB 415 be
left pending; without objection, it was so ordered.
The chair laid out SB 26 and recognized the author, Senator
Zaffirini, to explain the bill. Senator Averitt sent up a
committee substitute; the chair recognized Senator Zaffirini to
explain the difference between the committee substitute and the
bill as filed. Senator Averitt moved adoption of the committee
substitute; without objection, it was so ordered. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered. Senator Van de Putte
moved that SB 26 do not pass but that CSSB 26 be reported back
to the full committee with the recommendation that it do pass
and be printed. The motion carried with a record vote of 4
ayes, 0 nay, 0 present not voting, and 1 absent.
Upon arrival of a quorum, Senator Van de Putte moved adoption of
the committee substitute for SB 111; without objection, it was
so ordered. Senator Averitt moved that SB 111 do not pass but
that CSSB 111 be reported back to the full committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 3 ayes, 1 nay, 0 present not
voting, and 1 absent.
The chair laid out SB 413 and recognized the author, Senator
Madla, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Van de Putte moved that
SB 413 be reported favorably to the full committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 4 ayes, 0 nay, 0 present not
voting, and 1 absent.
At 4:54 p.m. Senator Averitt assumed the chair.
The chair laid out SB 1006 and recognized the author, Senator
West, to explain the bill. Senator West moved that SB 1006 be
reported favorably to the full committee with the recommendation
that it do pass and be printed. The motion carried with a
record vote of 5 ayes, 0 nay, 0 present not voting, and 0
absent.
At 4:57 p.m. Senator West resumed the chair.
The chair laid out SB 766 and recognized the author, Senator Van
de Putte, to explain the bill. Senator Van de Putte sent up
Committee Amendment 1 and moved adoption; without objection, the
amendment was adopted. Senator Van de Putte sent up Committee
Amendment 2 and moved adoption; without objection, the amendment
was adopted. Senator Van de Putte sent up Committee Amendment 3
and moved adoption; without objection, the amendment was
adopted. Witnesses testifying and registering on the bill are
shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Van de Putte moved that SB 766, as amended, be reported
back to the full committee with the recommendation that it do
pass and be printed. The motion carried with a record vote of 4
ayes, 0 nay, 0 present not voting, and 1 absent.

Ogden, to explain the bill. Witnesses testifying and

in the absence of the author, to explain the bill. Witnesses

moved that SB 545 be left pending; without objection, it was so
ordered.
Senator Van de Putte moved that SB 334, which was left pending
from a previous committee hearing, do not pass but that CSSB 334
be reported back to the full committee with the recommendation
that it do pass and be printed. The motion carried with a
record vote of 4 ayes, 0 nay, 0 present not voting, and 1
absent.
There being no further business, at 5:21 p.m. Senator West moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
