Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Standing Senate Subcommittee on
Higher Education was held on Monday, April 14, 2003, in the
Betty King Committee Hearing Room, 2E.20, at Austin, Texas.

The chair called the meeting to order at 4:19 p.m. There being
a quorum present, the following business was transacted:
There was no action taken for the following bill(s): SB 1292, SB
1608 & SB 1609
Senator Averitt moved adoption of the minutes from the previous
hearing held on April 7, 2003; without objection, it was so
ordered.
The chair laid out SB 800 and recognized the author, Senator
Madla, to explain the bill. Witnesses testifying and registering
on the bill are shown on the attached list. The chair moved
that the public testimony be closed; without objection, it was
so ordered. Senator Averitt moved that SB 800 be reported
favorably to the full committee with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 5 ayes, 0 nay, 0 present not voting, and 0 absent.
The chair laid out SB 1642 and recognized the author, Senator
Staples, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Staples moved that SB
1642 be reported favorably to the full committee with the
recommendation that it do pass and be printed. The motion

objection, it was so ordered.

Ogden, to explain the bill. Senator Averitt sent up a committee

filed. Senator Averitt moved adoption of the committee

Janek, to explain the bill. Senator Janek sent up a committee
substitute; the chair recognized Senator Janek to explain the
difference between the committee substitute and the bill as
filed. Senator Janek moved adoption of the committee
substitute; without objection, it was so ordered. Witnesses

Senator Van de Putte moved that HB 1055 be reported favorably to
the full committee with the recommendation that it do pass and
be printed. The motion carried with a record vote of 5 ayes, 0
nay, 0 present not voting, and 0 absent.
Upon arrival of a quorum, Senator Averitt moved that SB 1297 do
not pass but that CSSB 1297 be reported back to the full
committee with the recommendation that it do pass and be
printed. The motion carried with a record vote of 4 ayes, 0
nay, 0 present not voting, and 1 absent.
SB 1167 was left pending previously in the hearing, Senator
Janek moved that SB 1167 do not pass but that CSSB 1167 be
reported back to the full committee with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent
SB 1630 was left pending on April 7, 2003, Senator Averitt moved
that SB 1630 be reported favorably to the full committee with
the recommendation that it do pass and be printed. The motion
carried with a record vote of 4 ayes, 0 nay, 0 present not
voting, and 1 absent.
At 6:33 p.m. Senator Averitt assumed the chair.
The chair laid out SB 754 and recognized the author, Senator
West, to explain the bill. Senator West moved to reconsider the
motion by which the Committee Substitute for SB 754 was adopted
on April 7, 2003. There being no objection, it was so ordered.
Senator West sent up a new committee substitute; the chair
recognized Senator West to explain the difference between the
new committee substitute and the bill as filed. Senator West
moved adoption of the new committee substitute; without
objection, it was so ordered. Senator West moved that SB 754
do not pass but that CSSB 754 be reported back to the full
committee with the recommendation that it do pass and be
printed. The motion carried with a record vote of 4 ayes, 0
nay, 0 present not voting, and 1 absent.
At 6:37 p.m. Senator West resumed the chair.
There being no further business, at 6:37 p.m. Senator West moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
