         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Standing Senate Subcommittee on  
         Higher Education was held on Monday, April 28, 2003, in the  
         Betty King Committee Hearing Room, 2E.20, at Austin, Texas.

         The chair called the meeting to order at 1:35 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         Senator Van de Putte moved adoption of the minutes from the  
         previous hearings held on April 23, 2003, and April 24, 2003;  
         without objection, it was so ordered.   
          
         There was no action taken for the following bill(s): SB 462 & SB  
         1292 
          
         The chair laid out SB 1652 and recognized the author, Senator  
         Shapiro, to explain the bill. Senator Van de Putte sent up a  
         committee substitute; the chair recognized Senator Shapiro to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Van de Putte moved adoption of the  
         committee substitute; without objection, it was so ordered.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.  Senator Averitt  
         sent up Committee Amendment 1 and moved adoption.  The motion  
         carried with a record vote of 3 ayes, 0 nay, 1 present not  
         voting, and 0 absent.  Senator Van de Putte requested unanimous  
         consent to incorporate amendments into the committee substitute;  
         without objection, it was so ordered.  Senator Van de Putte then  
         moved that the new committee substitute be adopted; without  
         objection, it was so ordered.  Senator Van de Putte moved that  
         SB 1652 do not pass but that CSSB 1652 be reported back to the  
         full committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 1 absent.    
  
         The chair laid out SB 1778 and recognized Senator Estes, in the  
         absence of the author, to explain the bill.  Senator Van de  
         Putte sent up a committee substitute; the chair recognized  
         Senator Estes to explain the difference between the committee  
         substitute and the bill as filed.  Senator Van de Putte moved  
         adoption of the committee substitute; without objection, it was  
         so ordered.  
          
         At 2:41 p.m. Senator Averitt assumed the chair. 
          
         At 2:43 p.m. Senator West resumed the chair. 
              
         Witnesses testifying and registering on the SB 1778 are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.  Senator West  
         moved that SB 1778 be left pending; without objection, it was so  
         ordered.   
          
         The chair laid out HB 1649 and recognized the Senate sponsor,  
         Senator Van de Putte, to explain the bill.  Witnesses testifying  
         and registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator West moved that HB 1649  
         be left pending; without objection, it was so ordered.   
          
         The chair laid out HB 1650 and recognized the Senate sponsor,  
         Senator Van de Putte, to explain the bill.  Witnesses testifying  
         and registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator West moved that HB 1650  
         be left pending; without objection, it was so ordered.   
          
         The chair laid out SB 1127 and recognized the author, Senator  
         Van de Putte, to explain the bill. Senator Van de Putte sent up  
         a committee substitute; the chair recognized Senator Van de  
         Putte to explain the difference between the committee substitute  
         and the bill as filed.  Senator Van de Putte moved adoption of  
         the committee substitute; without objection, it was so ordered.

         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.  Senator West  
         moved that SB 1127 be left pending; without objection, it was so  
         ordered.   
          
         The chair laid out SB 1162 and recognized Senator Van de Putte,  
         in the absence of the author, to explain the bill.   Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Senator West moved that  
         SB 1162 be left pending; without objection, it was so ordered.   
          
         At 4:27 p.m. Senator West moved that the committee stand  
         recessed; without objection, it was so ordered.  
            
         At 4:52 p.m. the committee reconvened.

         There being no further business, at 4:53 p.m. Senator West moved  
         that the Committee stand recessed subject to the call of the
