Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Standing Senate Subcommittee on
Higher Education was held on Monday, May 5, 2003, in the Betty
King Committee Hearing Room, 2E.20, at Austin, Texas.

The chair called the meeting to order at 4:27 p.m. There being
a quorum present, the following business was transacted:
Senator Averitt moved adoption of the minutes from the previous
hearings held on April 28, 2003, and May 1, 2003; without
objection, it was so ordered.
The chair laid out SB 1546 and recognized the author, Senator
Janek, to explain the bill. Senator West moved that SB 1546 be
left pending to await the arrival of a committee substitute;
without objection, it was so ordered.
The chair laid out SB 1200 and recognized the author, Senator
Lucio, Jr., to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Averitt sent up
Committee Amendment 1 and moved adoption; without objection, the
amendment was adopted. Senator Averitt sent up Committee
Amendment 2 and moved adoption; without objection, the amendment
was adopted. Senator Averitt moved that SB 1200, as amended, be
reported back to the full committee with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 4 ayes, 0 nay, 0 present not voting, and 1 absent.
The chair laid out SB 1747 and recognized the author, Senator
Lucio, Jr., to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator West moved that SB 1747 be
left pending to await a quorum; without objection, it was so
ordered.
The chair laid out SB 1718 and recognized the author, Senator
Williams, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator West moved that SB 1718
be left pending; without objection, it was so ordered.
Left pending previously in the hearing, Senator Janek sent up a
committee substitute to SB 1546; the chair recognized Senator
Janek to explain the difference between the committee substitute
and the bill as filed. Senator Janek moved adoption of the
committee substitute; without objection, it was so ordered.

sent up Committee Amendment 1 and moved adoption; without

do not pass but that CSSB 1546 be reported back to the full
committee with the recommendation that it do pass and be
printed. The motion carried with a record vote of 4 ayes, 0
nay, 0 present not voting, and 1 absent.

absence of the author, to explain the bill. Senator Janek sent
up a committee substitute; the chair recognized Senator Janek to
explain the difference between the committee substitute and the
bill as filed. Senator Janek moved adoption of the committee
substitute; without objection, it was so ordered. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered. Senator Janek sent up
Committee Amendment 1 and moved adoption; without objection, the

Senator Van de Putte, to explain the bill. Senator Van de Putte
sent up a committee substitute; the chair recognized Senator Van
de Putte to explain the difference between the committee
substitute and the bill as filed. Senator Van de Putte moved
adoption of the committee substitute; without objection, it was
so ordered. Witnesses testifying and registering on the bill
are shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Van de Putte moved that HB 1649 do not pass but that
CSHB 1649 be reported back to the full committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 4 ayes, 0 nay, 0 present not
voting, and 1 absent.
The chair laid out HB 1650 and recognized the Senate sponsor,
Senator Van de Putte, to explain the bill. Senator West moved
that HB 1650 be left pending to wait the arrival of a committee
substitute; without objection, it was so ordered.
Upon arrival of a quorum, Senator Janek moved that SB 1747 be
reported favorably to the full committee with the recommendation
that it do pass and be printed. The motion carried with a
record vote of 4 ayes, 0 nay, 0 present not voting, and 1
absent.
Left pending previously in the hearing, Senator Van de Putte
sent up a committee substitute on HB 1650; the chair recognized
Senator Van de Putte to explain the difference between the
committee substitute and the bill as filed. Senator Van de
Putte moved adoption of the committee substitute; without
objection, it was so ordered. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Van de Putte moved that
HB 1650 do not pass but that CSHB 1650 be reported back to the
full committee with the recommendation that it do pass and be
printed. The motion carried with a record vote of 4 ayes, 0
nay, 0 present not voting, and 1 absent.
There being no further business, at 5:45 p.m. Senator West moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
