Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Finance was
held on Wednesday, March 12, 2003, in the Capitol Extension,
Room E1.036, at Austin, Texas.

The chair called the meeting to order at 9:04 a.m. The
following business was transacted:
The chair laid out SB 175 and recognized the author, Senator
Barrientos, to explain the bill. Senator Zaffirini sent up a
committee substitute; the chair recognized Senator Barrientos to
explain the difference between the committee substitute and the
bill as filed. Senator Zaffirini moved adoption of the
committee substitute; without objection, it was so ordered.
The chair laid out SB 340 and recognized the author, Senator
Staples, to explain the bill. Senator Duncan sent up a
committee substitute; the chair recognized Senator Staples to
explain the difference between the committee substitute and the
bill as filed. Senator Duncan moved adoption of the committee
substitute; without objection, it was so ordered.
The clerk called the roll. There was a quorum present.
Witnesses testifying and registering on SB 175 and SB 340 are
shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Bivins moved that SB 175 and SB 340 be left pending;
without objection, it was so ordered.
The chair laid out SB 423 and recognized the author, Senator
Nelson, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Averitt moved that SB 423
be reported favorably to the Senate with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 11 ayes, 0 nay, 0 present not voting, and 3 absent.
Senator Nelson moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered. The following Members asked unanimous consent to be
shown voting aye on SB 423: Senator Brimer, Senator Janek, and
Senator West.
The chair laid out SB 510 and SJR 25 and recognized the author,
Senator Staples, to explain the bills. Senator Duncan sent up
committee substitutes for SB 510 and SJR 25; the chair
recognized Senator Staples to explain the difference between the
committee substitutes and the bills as filed. Senator Duncan
moved adoption of the committee substitutes; without objection,
it was so ordered. Senator Nelson moved that SB 510 do not pass
but that CSSB 510 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 9 ayes, 0 nay, 0 present not
voting, and 6 absent. Senator Nelson moved that SJR 25 do not
pass but that CSSJR 25 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 9 ayes, 0 nay, 0 present not
voting, and 6 absent. The following Members asked unanimous
consent to be shown voting aye on CSSB 510 and CSSJR 25:
Senator Brimer and Senator West.
At 10:46 a.m. Senator Bivins moved that the committee stand
recessed until one hour after adjournment of the Senate; without
objection, it was so ordered.
At 1:22 p.m. the committee reconvened.
The chair laid out SB 456 and recognized Senator Barrientos, in
the absence of the author, to explain the bill. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered.
The chair laid out SJR 23 and recognized Senator Barrientos, in
the absence of the author, to explain the bill. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered.
Senator Bivins moved that SB 456 and SJR 23 be left pending;
without objection, it was so ordered.
There being no further business, at 1:32 p.m. Senator Bivins
moved that the Committee stand recessed subject to the call of
the chair. Without objection, it was so ordered.
