Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Finance was
held on Thursday, April 24, 2003, in the Capitol Extension, Room
E1.036, at Austin, Texas.

The chair called the meeting to order at 8:32 a.m. The
committee was in recess from the previous day. The following
business was transacted:
The chair laid out SB 823 and recognized the author, Senator
Fraser, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Bivins moved that SB 823
be left pending; without objection, it was so ordered.
At 9:22 a.m. Senator Zaffirini assumed the chair.
At 9:30 a.m. Senator Bivins resumed the chair.
The chair laid out SB 1522 and recognized the author, Senator
Zaffirini, to explain the bill. Senator Zaffirini sent up a
committee substitute; the chair recognized Senator Zaffirini to
explain the difference between the committee substitute and the
bill as filed. Witnesses testifying and registering on the bill
are shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Zaffirini moved adoption of the committee substitute;
without objection, it was so ordered. Senator Zaffirini moved
that SB 1522 do not pass but that CSSB 1522 be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 12 ayes, 0
nays, 0 present not voting, and 3 absent.
The chair laid out SB 480 and recognized the author, Senator
Madla, to explain the bill. Senator Zaffirini sent up a
committee substitute; the chair recognized Senator Madla to
explain the difference between the committee substitute and the
bill as filed. Witnesses testifying and registering on the bill
are shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Ogden moved adoption of the committee substitute;
without objection, it was so ordered. Senator Bivins moved that
SB 832 be left pending to await a quorum; without objection, it
was so ordered. Upon arrival of a quorum,
Senator Duncan sent up Committee Amendment 1 and moved adoption;
without objection, the amendment was adopted. Senator Shapleigh
sent up Committee Amendment 2 and moved adoption; without
objection, the amendment was adopted. Senator Zaffirini moved
to reconsider the vote on the committee substitute for SB 480;
without objection, it was so ordered. Senator Zaffirini asked
unanimous consent to incorporate the 2 amendments into the
committee substitute; without objection, it was so ordered.
Senator Zaffirini moved that SB 480 do not pass but that CSSB
480 be reported back to the Senate with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 13 ayes, 0 nays, 0 present not voting, and 2 absent.
Senator Shapleigh moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.

At 10:20 a.m. Senator Duncan assumed the chair.

absence of the author, to explain the bill. The bill was left
pending to await the committee substitute.
At 10:27 a.m. Senator Bivins resumed the chair.
The chair laid out SB 1664 and recognized the author, Senator
Averitt, to explain the bill. Senator Averitt sent up Committee
Amendment 1. Senator Averitt sent up a committee substitute;
the chair recognized Senator Averitt to explain the difference
between the committee substitute and the bill as filed.

the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered. The bill was left
pending to await a quorum. Upon arrival of a quorum, Senator
Averitt moved adoption of the amendment for SB 1664; without
objection, the amendment was adopted. Senator Averitt requested
unanimous consent to incorporate the amendment into the

Senator Averitt then moved that the new committee substitute be
adopted; without objection, it was so ordered. Senator Averitt
moved that SB 1664 do not pass but that CSSB 1664 be reported
back to the Senate with the recommendation that it do pass and
be printed. The motion carried with a record vote of 15 ayes, 0
nay, 0 present not voting, and 0 absent. Senator Averitt moved
that the bill be recommended for placement on the Local &

moved that the Committee stand recessed subject to the call of
