Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Finance was
held on Monday, May 5, 2003, in the Capitol Extension, Room
E1.036, at Austin, Texas.

The chair called the meeting to order at 8:15 a.m. There being
a quorum present, the following business was transacted:
The chair laid out SB 1370 and recognized the author, Senator
Duncan, to explain the bill. Senator Duncan sent up a committee
substitute; the chair recognized Senator Duncan to explain the
difference between the committee substitute and the bill as
filed. Witnesses testifying and registering on the bill are
shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Duncan moved adoption of the committee substitute;
without objection, it was so ordered. Senator Bivins moved that
SB 1370 be left pending to await a quorum; without objection, it
was so ordered. Upon arrival of a quorum, Senator Duncan moved
that SB 1370 do not pass but that CSSB 1370 be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 9 ayes, 3
nays, 0 present not voting, and 3 absent.
The chair laid out SB 1369 and recognized the author, Senator
Duncan, to explain the bill. Senator Duncan sent up a committee
substitute; the chair recognized Senator Duncan to explain the
difference between the committee substitute and the bill as

nay, 0 present not voting, and 4 absent. Senator Zaffirini
moved that the bill be recommended for placement on the Local &
Uncontested Calendar; without objection, it was so ordered.
The chair laid out SB 124 and recognized the author, Senator
Shapleigh, to explain the bill. Senator Shapleigh sent up a
committee substitute; the chair recognized Senator Shapleigh to
explain the difference between the committee substitute and the
bill as filed. Witnesses testifying and registering on the bill

At 10:56 a.m. Senator Bivins moved that the committee stand
recessed until 30 minutes after adjournment of the Senate;
without objection, it was so ordered.
At 4:42 p.m. the committee reconvened.

Senator Zaffirini to explain the difference between the
committee substitute and the bill as filed. Without objection
the committee substitute for SB 1592 was adopted. Witnesses

hearing. Senator Zaffirini sent up a committee substitute.
Senator Zaffirini moved adoption of the committee substitute;
without objection, it was so ordered. Senator Bivins moved that
SB 823 be left pending; without objection, it was so ordered.
There being no further business, at 5:48 p.m. Senator Bivins
moved that the Committee stand recessed subject to the call of
the chair. Without objection, it was so ordered.
