Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Finance was
held on Friday, September 19, 2003, in the Capitol Extension,
Room E1.036, at Austin, Texas.

The chair called the meeting to order at 10:54 a.m. There being
a quorum present, the following business was transacted:
At 10:54 a.m. Senator Zaffirini assumed the chair.
The chair laid out HB 23 and recognized the Senate sponsor,
Senator Bivins, to explain the bill. There was no public
testimony on the bill. Senator Bivins moved that HB 23 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 10 ayes, 0 nay, 0 present not voting, and 5 absent.
The chair laid out HB 24 and recognized the Senate sponsor,
Senator Bivins, to explain the bill. There was no public
testimony on the bill. Senator Bivins moved that HB 24 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 10 ayes, 0 nay, 0 present not voting, and 5 absent.

substitute; the chair recognized Senator Bivins to explain the
difference between the committee substitute and the bill as
filed. Senator Bivins moved adoption of the committee
substitute; without objection, it was so ordered. Senator
Bivins moved that HB 28 do not pass but that CSHB 28 be reported
back to the Senate with the recommendation that it do pass and
be printed. The motion carried with a record vote of 10 ayes, 0
nay, 0 present not voting, and 5 absent.
The chair laid out HB 29 and recognized the Senate sponsor,
Senator Bivins, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Bivins moved that HB 29
be reported favorably to the Senate with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 10 ayes, 0 nay, 0 present not voting, and 5 absent.
At 11:19 a.m. Senator Bivins resumed the chair.
The chair laid out HB 37 and recognized the Senate sponsor,
Senator Ogden, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Ogden moved that HB 37 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 10 ayes, 0 nay, 0 present not voting, and 5 absent.
The chair laid out HB 35 and recognized the Senate sponsor,
Senator Ogden, to explain the bill. There was no public
testimony on the bill. Senator Ogden moved that HB 35 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 10 ayes, 0 nay, 0 present not voting, and 5 absent.
At 11:20 a.m. Senator Bivins moved that the committee stand
recessed until 11:45 a.m; without objection, it was so ordered.
At 12:05 p.m. the committee reconvened.
The chair laid out HB 7 and recognized the Senate sponsor,
Senator Ogden, to explain the bill. Senator Ogden sent up a
committee substitute; the chair recognized Senator Ogden to
explain the difference between the committee substitute and the
bill as filed. Senator Ogden sent up Committee Amendment 1.
Senator Ogden requested unanimous consent to adopt the
amendment, roll the amendment into the committee substitute and
adopt the committee substitute. The motion carried with a
record vote of 9 ayes, 0 nay, 1 present not voting, and 5
absent.
At 12:15 p.m. Senator Bivins moved that the committee stand
recessed until 12:45 p.m; without objection, it was so ordered.
At 12:47 p.m. the committee reconvened.
Public testimony was taken for HB 7. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Ogden moved that HB 7 do
not pass but that CSHB 7 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 9 ayes, 4 nays, 0 present not
voting, and 2 absent.
There being no further business, at 1:14 p.m. Senator Bivins
moved that the Committee stand recessed subject to the call of
the chair. Without objection, it was so ordered.
