Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Jurisprudence
was held on Wednesday, March 5, 2003, in the Capitol Extension,
Room E1.012, at Austin, Texas.

The chair called the meeting to order at 1:30 p.m. There being
a quorum present, the following business was transacted:
The chair laid out SB 358 and recognized the author, Senator
Shapiro, to explain the bill. Senator Averitt sent up a
committee substitute; the chair recognized Senator Shapiro to
explain the difference between the committee substitute and the
bill as filed. Senator Averitt moved adoption of the committee
substitute; without objection, it was so ordered. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered. Without objection, SB 358
was left pending before the Committee.
The chair laid out SB 122 and recognized the author, Senator
Lindsay, to explain the bill. Senator Harris sent up a
committee substitute; the chair recognized Senator Lindsay to
explain the difference between the committee substitute and the
bill as filed. Senator Harris moved adoption of the committee
substitute; without objection, it was so ordered. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered. Without objection, the
committee substitute for SB 122 was left pending before the
Committee.
The chair laid out SB 504 and recognized the author, Senator
Ogden, to explain the bill. Senator Harris sent up Committee
Amendment 1 and moved adoption; without objection, the amendment
was adopted. Witnesses testifying and registering on the bill
are shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Harris moved that SB 504, as amended, be reported back
to the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 5 ayes, 1
nay, 0 present not voting, and 1 absent.
The chair laid out SB 105 and recognized the author, Senator
Averitt, to explain the bill. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Lucio moved that SB 105 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 5 ayes, 1 nay, 0
present not voting, and 1 absent. Senator Averitt moved that the
bill be recommended for placement on the Local & Uncontested
Calendar, there was objection, the motion failed.
The chair laid out pending bill CSSB 379 and recognized the
author, Senator Armbrister, to discuss the bill. Senator Lucio
moved to reconsider the vote by which the committee substitute
for SB 379 was adopted, without objection, the committee
substitute was laid on the table, subject to amendment. Senator
Lucio sent up Committee Amendment 1 to the committee substitute
for SB 379. Senator Lucio then withdrew Committee Amendment 1
from consideration by the Committee. Without objection, SB 379
was left pending before the Committee.
The chair laid out SB 354 and recognized the author, Senator
Harris, to explain the bill. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Gallegos moved that SB 354 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 6 ayes, 0 nay, 0
present not voting, and 1 absent. Senator Harris moved that the
bill be recommended for placement on the Local & Uncontested
Calendar; without objection, it was so ordered.
Senator Gallegos assumed the chair.
The chair laid out SB 520 and recognized the author, Senator
Duncan, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Lucio moved that SB 520
be reported favorably to the Senate with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent.
Senator Duncan resumed the chair.

so ordered.
There being no further business, Senator Duncan moved that the
Committee stand recessed subject to the call of the chair.
