         Pursuant to suspension of Senate Rule 11.18, a public hearing of  
         the Senate Committee on Jurisprudence was held on Friday, May  
         16, 2003, in the Senator Duncan's Desk at Austin, Texas.

         The chair called the meeting to order at 4:15 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         The chair laid out pending business HB 729.  Senator Harris  
         moved that HB 729 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 2 absent.   
          
         Senator Lucio assumed the chair.   
          
         The chair laid out pending business HB 803.  A committee  
         substitute was adopted at a previous hearing.  Senator Duncan  
         moved that HB 803 do not pass but that CSHB 803 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 5 ayes, 0  
         nay, 0 present not voting, and 2 absent.  Senator Duncan moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         Senator Duncan resumed the chair.   
          
         The chair laid out pending business HB 913. Senator Lucio moved  
         that HB 913 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
  
         voting, and 2 absent.  Senator Harris moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out pending business HB 1391.  Senator Lucio  
         moved that HB 1391 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 2 absent.  Senator West moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out pending business HB 1590.  Senator Averitt  
         sent up a committee substitute at a previous hearing.  Senator  
         Averitt moved adoption of the committee substitute; without  
         objection, it was so ordered.  Senator West moved that HB 1590  
         do not pass but that CSHB 1590 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 5 ayes, 0 nay, 0 present  
         not voting, and 2 absent.  Senator Averitt moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.

         moved that HB 1709 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 2 absent.  Senator Harris moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.

         moved that HB 1815 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion

         voting, and 2 absent.  Senator Harris moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out pending business HB 2188.  Committee  
         Amendment 1 was sent up by Senator Harris at a previous hearing.   
         Senator Harris moved adoption of Committee Amendment 1; without  
         objection, the amendment was adopted.  Senator Lucio moved that  
         HB 2188, as amended, be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 2 absent.  Senator Lucio moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out pending business HB 2189.  Committee  
         Amendment 1 was sent up by Senator Harris at a previous hearing.   
         Senator Harris moved adoption of Committee Amendment 1; without  
         objection, the amendment was adopted.  Senator Harris moved that  
  
         HB 2189, as amended, be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 2 absent.  Senator Harris moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out pending business HB 2341.  Senator Lucio  
         moved that HB 2341 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 2 absent.  Senator Lucio moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out pending business HB 3595.  Senator Lucio  
         moved that HB 3595 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 2 absent. Senator Lucio moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.  
          
         The chair laid out pending business HB 3603.  Senator Lucio  
         moved that HB 3603 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 2 absent.  Senator Lucio moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
         Senator Gallegos requested unanimous consent to be shown aye on  
         the following bills:  HB 803, HB 913, HB 1391, HB 1590, HB 1709,  
         HB 1815, HB 2184, HB 2341, HB 3595, HB 3603 and HB 2188; without  
         objection, it was so ordered. 
          
         Senator Gallegos also requested unanimous consent to be shown  
         voting nay on HB 729; without objection, it was so ordered. 
          
         There being no further business, the Committee stood recessed
