Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Jurisprudence
was held on Friday, September 19, 2003, in the Capitol
Extension, Room E1.012, at Austin, Texas.

The chair called the meeting to order at 11:11 a.m. There being
a quorum present, the following business was transacted:
The chair laid out HB 1 and recognized the Senate sponsor,
Senator Nelson, to explain the bill. Senator Averitt sent up
Committee Amendment 1.
Testimony was taken, witnesses are shown on the attached list.
Senator Averitt moved adoption of Committee Amendment 1. The
motion carried with a record vote of 4 ayes, 3 nays, 0 present
not voting, and 0 absent.
Senator Averitt moved that Committee Amendment 1 be rolled into
the original bill, creating a new substitute; without objection,
it was so ordered. Senator Averitt moved adoption of the new
committee substitute; the motion carried with a record vote of 4
ayes, 3 nays, 0 present not voting, and 0 absent.
The chair laid out HB 3 and recognized the Senate sponsor,
Senator Staples, to explain the bill. Senator Staples sent up a
committee substitute (Plan 01353C); the chair recognized Senator
Staples to explain the difference between the committee
substitute and the bill as filed. Senator Staples moved
adoption of the committee substitute. The motion carried with a
record vote of 4 ayes, 3 nays, 0 present not voting, and 0
absent. Senators Lucio, Gallegos, West, and Averitt offered
closing remarks. Senator Averitt moved that HB 3 do not pass
but that CSHB 3 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 4 ayes, 3 nays, 0 present not
voting, and 0 absent.
There being no further business, at 12:25 p.m. Senator Duncan
moved that the committee stand recessed subject to the call of
the chair. Without objection, it was so ordered.
