Senator Averitt sent up Committee Amendment 1. Testimony was taken, witnesses are shown on the attached list. Senator Averitt moved adoption of Committee Amendment 1. The motion carried with a record vote of 4 ayes, 3 nays, 0 present not voting, and 0 absent. Senator Averitt moved that Committee Amendment 1 be rolled into the original bill, creating a new substitute; without objection, it was so ordered. Senator Averitt moved adoption of the new committee substitute; the motion carried with a record vote of 4 ayes, 3 nays, 0 present not voting, and 0 absent. The chair laid out HB 3 and recognized the Senate sponsor, Senator Staples, to explain the bill. Senator Staples sent up a committee substitute (Plan 01353C); the chair recognized Senator Staples to explain the difference between the committee substitute and the bill as filed. Senator Staples moved adoption of the committee substitute. The motion carried with a record vote of 4 ayes, 3 nays, 0 present not voting, and 0 absent. Senators Lucio, Gallegos, West, and Averitt offered closing remarks. Senator Averitt moved that HB 3 do not pass but that CSHB 3 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 4 ayes, 3 nays, 0 present not voting, and 0 absent. There being no further business, at 12:25 p.m. Senator Duncan moved that the committee stand recessed subject to the call of the chair.
