         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on State Affairs  
         was held on Monday, February 17, 2003, in the Senate Chamber at  
         Austin, Texas.

         Chairman Ratliff called the meeting to order at 2:34 p.m.  There  
         being a quorum present, the following business was transacted:  
          
         Chairman Ratliff discussed a procedure by which the minutes  
         would be distributed after each hearing and if any member had a  
         question regarding the minutes it would be discussed at the next  
         posted hearing.  This procedure was acceptable to the committee  
         members. 
          
         The chairman laid out SB 84 and recognized the author, Senator  
         Wentworth, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that public testimony be closed; without objection,  
         it was so ordered.  Senator Duncan moved that SB 84 be reported  
         favorably to the Senate with the recommendation that it do pass  
         and be printed.  Pursuant to a motion in writing, unanimous  
         consent was requested and granted for Senators Armbrister,  
         Fraser, and Staples to be shown voting aye.  The motion carried  
         with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1  
         absent (the 8 ayes include the motions in writing).   
          
         The chairman laid out SB 121 and recognized the author, Senator  
         Lindsay, to explain the bill.  Senator Ellis sent up a committee  
         substitute; the chair recognized Senator Lindsay to explain the  
         difference between the committee substitute and the bill as  
  
         filed.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  The chair moved that public  
         testimony be closed; without objection, it was so ordered.   
         Senator Nelson moved that SB 121 do not pass but that CSSB 121  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  Pursuant to a motion in writing,  
         unanimous consent was requested and granted for Senators Fraser  
         and Staples to be shown voting aye.  The motion carried with a  
         record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent  
         (the 8 ayes include the motions in writing).   
          
         There being no further business, at 2:51 p.m., Chairman Ratliff  
         moved that the Committee be adjourned. Without objection, it was  
         so ordered.
