MINUTES SENATE COMMITTEE ON STATE AFFAIRS Tuesday, July 8, 2003 1:30 p.m. or upon adjournment Senate Chamber ***** Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on State Affairs was held on Tuesday, July 8, 2003, in the Senate Chamber at Austin, Texas. ***** MEMBERS PRESENT: MEMBERS ABSENT: Senator Bill Ratliff Senator Robert Duncan Senator Todd Staples Senator Chris Harris Senator Kenneth Armbrister Senator Rodney Ellis Senator Troy Fraser Senator Frank Madla Senator Jane Nelson ***** Chairman Ratliff called the meeting to order at 2:20 p.m. There being a quorum present, the following business was transacted: There was no action taken for the following bill(s): SB 9, SB 11, SB 12. The chairman announced that the committee rules adopted for the 78th Legislature, Regular Session were still in place for the 78th Legislature, First Called Session. Chairman Ratliff laid out SB 26 and recognized the author, Senator Nelson, to explain the bill. Witnesses registering on the bill are shown on the attached list. The chairman moved that the public testimony be closed; without objection, it was so ordered. Senator Nelson sent up a committee substitute; the chairman recognized Senator Nelson to explain the difference between the committee substitute and the bill as filed. Senator Nelson moved adoption of the committee substitute; without objection, it was so ordered. Chairman Ratliff moved that SB 26 be left pending to await a quorum; without objection, it was so ordered. Later in the hearing and upon arrival of a quorum, Senator Nelson moved that SB 26 do not pass but that CSSB 26 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 4 absent. The chairman laid out SB 8 and recognized the author, Senator Janek, to explain the bill. Senator Nelson sent up a committee substitute; the chair recognized Senator Janek to explain the difference between the committee substitute and the bill as filed. Witnesses testifying and registering on the bill are shown on the attached list. At 3:37 p.m., Senator Armbrister assumed the chair. At 3:40 p.m., Chairman Ratliff resumed the chair and testimony continued. At 5:12 p.m., Senator Armbrister assumed the chair and read several cards into the record. Senator Armbrister moved that the public testimony be closed; without objection, it was so ordered. Senator Armbrister then moved that SB 8 (and the Nelson substitute) be left pending; without objection, it was so ordered. The committee stood at ease until 5:21 p.m. Chairman Ratliff resumed the chair and announced that the committee would meet on Wednesday, July 9, 2003, to consider, as pending business, SB 8. There being no further business, at 5:25 p.m., Chairman Ratliff moved that the Committee stand recessed subject to the call of the chair.
