MINUTES SENATE COMMITTEE ON STATE AFFAIRS Wednesday, July 9, 2003 1:30 p.m. or upon adjournment Senate Chamber ***** Pursuant to suspension of Senate Rule 11.18, a public hearing of the Senate Committee on State Affairs was held on Wednesday, July 9, 2003, in the Senate Chamber at Austin, Texas. ***** MEMBERS PRESENT: MEMBERS ABSENT: Senator Bill Ratliff Senator Todd Staples Senator Kenneth Armbrister Senator Robert Duncan Senator Rodney Ellis Senator Chris Harris Senator Troy Fraser Senator Frank Madla Senator Jane Nelson ***** Chairman Ratliff called the meeting to order at 2:08 p.m., and announced that both SB 8 (pending business) and SB 41 would be considered during the hearing. In addition, since a new substitute to SB 8 would be offered testimony would be reopened. The chairman laid out, as pending business, SB 8 and recognized Senator Armbrister for a motion. Senator Armbrister moved to withdraw the Nelson committee substitute offered on July 8th; there being no objection, it was so ordered. Senator Armbrister then sent up a new committee substitute; the chair recognized Senator Janek, the author of SB 8, to explain the Armbrister committee substitute. Senator Armbrister then moved to reconsider the motion by which testimony on SB 8 was closed on July 8th; there being no objection, it was so ordered. Witnesses testifying on the Armbrister substitute are shown on the attached list. Chairman Ratliff moved that SB 8 be left pending; without objection, it was so ordered. The chairman laid out SB 41 and recognized Senator Hinojosa, in the absence of the author, to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list. The chairman moved that the public testimony be closed; without objection, it was so ordered. During public testimony, Senator Armbrister was briefly in the chair. Next, the chairman announced that upon the arrival of a quorum, he would entertain a motion on either SB 8 or SB 41. While waiting, Senator Nelson moved to adopt the Armbrister substitute to SB 8; without objection, it was so ordered. Upon the arrival of a quorum, Senator Nelson moved that SB 8 do not pass but that CSSB 8 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 1 nay, 0 present not voting, and 3 absent. There being no further motions, at 3:50 p.m., Chairman Ratliff moved that the Committee stand recessed subject to the call of the chair.
