         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Standing Senate Subcommittee on  
         Agriculture was held on Thursday, March 27, 2003, in the Capitol  
         Extension, Room E1.012, at Austin, Texas.

         The chair called the meeting to order at 1:04 p.m.  There being  
         a quorum present, the following business was transacted:  
          
         The chair laid out SB 1451 and recognized the author, Senator  
         Carona, to explain the bill.  Senator Estes sent up a committee  
         substitute; the chair recognized Senator Carona to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Estes moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Senator Estes moved that  
         SB 1451 do not pass but that CSSB 1451 be reported back to the  
         full committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 2 ayes, 0  
         nay, 0 present not voting, and 1 absent.   
          
         The chair laid out SB 1413 and recognized the author, Senator  
         Deuell, to explain the bill.  Senator Estes sent up a committee  
         substitute; the chair recognized Senator Deuell to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Estes moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Senator Estes moved that  
         SB 1413 do not pass but that CSSB 1413 be reported back to the  
         full committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 2 ayes, 0  
         nay, 0 present not voting, and 1 absent.   
  
         The chair laid out SB 1268 and recognized the author, Senator  
         Estes, to explain the bill.  Senator Estes sent up a committee  
         substitute; the chair recognized Senator Estes to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Estes moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Senator Estes moved that  
         SB 1268 do not pass but that CSSB 1268 be reported back to the  
         full committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 2 ayes, 0  
         nay, 0 present not voting, and 1 absent.   
          
         Senator Estes assumed the chair.   
          
         The chair laid out SB 1389 and recognized the author, Senator  
         Duncan, to explain the bill.  Senator Duncan sent up a committee  
         substitute; the chair recognized Senator Duncan to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Duncan moved adoption of the committee  
         substitute; without objection, it was so ordered.  Senator  
         Duncan sent up Committee Amendment 1 and moved adoption; without  
         objection, the amendment was adopted. Senator Duncan requested  
         unanimous consent to incorporate amendment into the committee  
         substitute; without objection, it was so ordered.  Senator  
         Duncan then moved that the new committee substitute be adopted;  
         without objection, it was so ordered.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Duncan moved that SB 1389  
         do not pass but that CSSB 1389 be reported back to the full  
         committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 2 ayes, 0  
         nay, 0 present not voting, and 1 absent. 
          
         Senator Duncan resumed the chair.   
          
         The chair laid out SB 1405 and recognized Senator Estes, in the  
         absence of the author, to explain the bill.  Senator Estes sent  
         up a committee substitute; the chair recognized Senator Estes to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Estes moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Senator Estes moved that  
         SB 1405 do not pass but that CSSB 1405 be reported back to the  
         full committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 2 ayes, 0  
         nay, 0 present not voting, and 1 absent.   
          
         Senator Lucio assumed the chair. 
                                                                            
         Senator Lucio requested unanimous consent to be shown voting aye  
         on the following bills: 
         SB 1389, SB 1268, SB 1413, SB 1451, SB 1405; without objection,  
         it was so ordered. 
          
         The chair laid out SB 498 and recognized Senator Estes, in the  
         absence of the author, to explain the bill.  Senator Estes sent  
         up a committee substitute; the chair recognized Senator Estes to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Estes moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Senator Estes moved that  
         SB 498 do not pass but that CSSB 498 be reported back to the  
         full committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 2 ayes, 0  
         nay, 0 present not voting, and 1 absent.   
          
         The chair laid out SB 1123 and recognized the author, Senator  
         Staples, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Estes moved that SB 1123  
         be reported favorably to the full committee with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 2 ayes, 0 nay, 0 present not  
         voting, and 1 absent.   
          
         There was no action taken for the following bill(s): SB 1052. 
          
         There being no further business, Senator Duncan moved that the  
         Committee stand recessed subject to the call of the chair.   
         Without objection, it was so ordered.
