11.18, a public hearing of the Senate Committee on Health &
Human Services was held on Tuesday, March 18, 2003, in the
Senate Chamber at Austin, Texas.

The Chair called the meeting to order at 1:30 p.m. The
following business was transacted:
The Chair laid out Senate Bill 144 and recognized its author,
Senator Averitt.
Senator Averitt announced that he had a committee substitute.
Senator Zaffirini sent up the committee substitute for Senate
Bill 144 and yielded to its author to explain the substitute.
Senator Averitt explained the substitute.
A quorum was established at 1:36 p.m.
Senator Janek moved that the minutes from the previous hearing
be approved; without objection, the minutes were approved by
unanimous consent.
The Chair opened the floor for public testimony on Senate Bill
144. Witnesses testifying and registering on Senate Bill 144
are shown on the attached list.
The Chair closed public testimony.
The Chair announced that Senate Bill 144 would be left pending.
The Chair laid out Senate Bill 803 and recognized its author,
Senator Janek, to explain the bill.
Senator Janek explained the bill.
The Chair opened the floor for public testimony. Witnesses
testifying and registering on the bill are shown on the attached
list.
The Chair closed public testimony.
The Chair announced that Senate Bill 803 would be left pending.
The Chair laid out Senate Bill 939 and recognized its author,
Senator Janek, to explain the bill.

Senator Janek sent up the committee substitute for Senate Bill
939.

The Chair clarified that Yvonne Barton had registered in favor
of Senate Bill 144.
The Chair recalled Senate Bill 144 which had previously been
left pending.
The Chair moved adoption of the committee substitute for Senate
Bill 144; without objection, the motion carried.
Senator Janek moved that Senate Bill 144 do not pass but that
the committee substitute for Senate Bill 144 be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 9 ayes, 0
nays, and 0 absent. Senators Carona, Lindsay, West and
Zaffirini asked to be shown voting aye; without objection, the
motion carried.
The Chair recalled Senate Bill 803 which had previously been
left pending.
Senator Janek moved that Senate Bill 803 be reported favorably
to the Senate with the recommendation that it do pass and be

printed. The motion carried with a record vote of 9 ayes, 0
nays, and 0 absent. Senators Carona, Lindsay, West and
Zaffirini asked to be shown voting aye; without objection, the
motion carried.
Senator Janek moved that Senate Bill 803 be recommended for the
Local & Uncontested Calendar; without objection, the motion
carried.
The Chair recalled Senate Bill 939 which had previously been
left pending.
The Chair moved adoption of the committee substitute for Senate
Bill 939; without objection, the motion carried.
Senator Janek moved that Senate Bill 939 do not pass but that
the committee substitute for Senate Bill 939 be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 9 ayes, 0
nays, and 0 absent. Senators Carona, Lindsay, West and
Zaffirini asked to be shown voting aye; without objection, the
motion carried.
Senator Janek moved that Senate Bill 939 be recommended for the
Local & Uncontested Calendar; without objection, the motion
carried.
There being no further business, at 2:18 p.m. the Chair moved
that the Committee stand recessed subject to the call of the
Chair. Without objection, it was so ordered.
