         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Infrastructure Development  
         and Security Committee was held on Monday, April 14, 2003, in  
         the Capitol Extension, Room E1.028, at Austin, Texas.

         The chair called the meeting to order at 10:05 a.m.  There being  
         a quorum present, the following business was transacted:          
          
         Senator Lindsay moved adoption of the minutes from the previous  
         hearing held on April 7, 2003; without objection, it was so  
         ordered.   
          
         The chair referred the following bill to the Special Select  
         Subcommittee for further consideration:  HB 1191 by  
         Allen/Wentworth, relating to the confidentiality of certain  
         sensitive information. 
          
         The chair laid out SB 425, relating to the marketing and sale of  
         prestige and specialized license plates, and recognized Senator  
         Wentworth, in the absence of the author, to explain the bill.   
         Senator Wentworth moved adoption of the subcommittee report for  
         SB 425.  Senator Wentworth then withdrew the motion for the  
         adoption of the subcommittee report for SB 425, and moved to  
         leave the bill pending in the Special Select Subcommittee;  
         without objection, it was so ordered. 
          
         The chair laid out SB 485, relating to the use of exclusive  
         development agreements by an intermunicipal commuter rail  
  
         district, and recognized the author, Senator Barrientos, to  
         explain the bill.  The chair moved that the bill be left  
         pending, awaiting public testimony; without objection, it was so  
         ordered.        
          
         The chair laid out SB 1504, relating to the duties and authority  
         of the Texas Motor Vehicle Board, and recognized the author,  
         Senator Harris, to explain the bill.  Senator Shapiro sent up  
         Committee Amendment 1.  The chair moved that the bill be left  
         pending, awaiting public testimony; without objection, it was so  
         ordered. 
          
         The chair laid out SB 1507, relating to the use of powers of  
         attorney in certain motor vehicle transfers, and recognized the  
         author, Senator Harris, to explain the bill.  Senator Wentworth  
         sent up a committee substitute; the chair recognized Senator  
         Wentworth to explain the difference between the committee  
         substitute and the bill as filed.  Senator Wentworth moved  
         adoption of the committee substitute; without objection, it was  
         so ordered.  Senator Shapleigh sent up Committee Amendment 1.  
         The chair moved that the bill be left pending, awaiting public  
         testimony; without objection, it was so ordered. 
          
         The chair laid out SB 1748, relating to the continuation of the  
         law authorizing the issuance of oversize or overweight vehicle  
         permits by certain port authorities, and recognized the author,  
         Senator Lucio, Jr., to explain the bill.  The chair moved that  
         the bill be left pending, awaiting public testimony; without  
         objection, it was so ordered. 
          
         The chair laid out SB 1635, relating to the use of all-terrain  
         vehicles, and recognized the author, Senator Staples, to explain  
         the bill.  Senator Deuell sent up a committee substitute; the  
         chair recognized Senator Staples to explain the difference  
         between the committee substitute and the bill as filed.  Senator  
         Deuell moved adoption of the committee substitute; without  
         objection, it was so ordered.  The chair moved that the bill be  
         left pending, awaiting public testimony; without objection, it  
         was so ordered. 
          
         The chair laid out SB 1464, relating to enforcement of the  
         collection of certain tolls; providing a penalty, and recognized  
         the author, Senator Lindsay, to explain the bill. Senator  
         Lindsay sent up a committee substitute; the chair recognized  
         Senator Lindsay to explain the difference between the committee  
         substitute and the bill as filed.  Senator Lindsay moved  
         adoption of the committee substitute; without objection, it was  
         so ordered.  Senator Lindsay sent up Committee Amendment 1 and  
         moved adoption; without objection, the amendment was adopted.   
         The chair moved that the bill be left pending, awaiting public  
         testimony; without objection, it was so ordered. 
          
         The chair laid out SB 1904, relating to the eligibility of a  
         person to operate a commercial motor vehicle in this state, and  
  
         recognized the author, Senator Barrientos, to explain the bill.

         The chair laid out SB 488, relating to vehicle weight, and  
         recognized the author, Senator Ogden, to explain the bill.  The  
         chair moved that the bill be left pending, awaiting public  
         testimony; without objection, it was so ordered.

         The chair laid out SB 1499, relating to contracts for the design  
         and construction of transportation projects by the Texas  
         Department of Transportation, and recognized the author, Senator  
         Madla, to explain the bill.   
          
         At 11:22 a.m. Senator Barrientos assumed the chair.

         At 11:27 a.m. Senator Ogden resumed the chair.   
          
         The chair moved that the bill be left pending awaiting the

         of a portion of State Highway 195 as the Phantom Warriors  
         Highway, which had been left pending at a previous hearing.   
         Senator Wentworth moved adoption of a committee substitute sent  
         up at a previous hearing; without objection, it was so ordered.   
         Senator Wentworth moved that SB 233 do not pass but that CSSB  
         233 be reported back to the Senate with the recommendation that  
         it do pass and be printed. Senator Madla requested unanimous  
         consent to be shown voting aye on SB 233; without objection, it  
         was so ordered. The motion carried with a record vote of 8 ayes,  
         0 nay, 0 present not voting, and 1 absent.  Senator Wentworth  
         moved that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out SB 409 by Lucio, relating to the membership  
         of the Texas Transportation Commission, which had been left  
         pending at a previous hearing.  Senator Madla requested  
         unanimous consent to be shown voting aye on SB 409; without  
         objection, it was so ordered. 
          
         Senator Shapleigh moved that SB 409 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 8 ayes, 0 nay, 0  
         present not voting, and 1 absent.   
          
         The chair laid out SB 1184 by Deuell, relating to the  
         enforcement of commercial motor vehicle safety standards, which  
         had been left pending at a previous hearing.  Senator Madla and  
         Senator Shapiro requested unanimous consent to be shown voting  
         aye on SB 1184; without objection, it was so ordered.  Senator  
         Deuell moved that SB 1184 be reported favorably to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 9 ayes, 0 nay, 0 present

         1348 be reported back to the Senate with the recommendation that

         moved to pull down a committee substitute sent up at a previous  
         hearing; without objection, it was so ordered.  Senator Lindsay  
         sent up a new committee substitute; the chair recognized Senator  
         Lindsay to explain the difference between the committee  
         substitute and the bill as filed.  Senator Lindsay moved  
         adoption of the committee substitute; without objection, it was  
         so ordered.  Senator Lindsay moved that SB 1445 do not pass but  
         that CSSB 1445 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  Senator Shapiro
