         Pursuant to suspension of Senate Rule 11.18, a  public hearing  
         of the Special Select Subcommittee  was held on Tuesday, April  
         22, 2003, at Senator Wentworth's Desk in the Senate Chamber at  
         Austin, Texas.

         Senator Jeff Wentworth, the chair, called the meeting to order  
         at 1:37 p.m.  There being a quorum present, the following  
         business was transacted: 
          
         Senator Wentworth moved to pull down a committee substitute sent  
         up at a previous hearing; without objection, it was so ordered.   
         Senator Wentworth sent up a new committee substitute and  
         explained the difference between the committee substitute and  
         the bill as filed.  Senator Shapleigh moved adoption of the  
         committee substitute; without objection, it was so ordered.   
         Senator Shapleigh moved that SB 1704 do not pass but that CSSB  
         1704 be reported back to the full committee with the  
         recommendation that it do pass.  The motion carried with a  
         record vote of 3 ayes, 0 nay, 0 present not voting, and 0  
         absent. 
          
         There being no further business, at 1:40 p.m. Senator Wentworth  
         moved that the Subcommittee stand recessed subject to the call  
         of the chair.  Without objection, it was so ordered.
