Pursuant to suspension of Senate Rule 11.18, a public hearing of
the Senate Infrastructure Development and Security Committee was
held on Thursday, May 8, 2003, in the Senate Chamber, at Senator
Ogden's desk, at Austin, Texas.

The chair called the meeting to order at 2:14 p.m. There being
a quorum present, the following business was transacted:
At 2:19 p.m. Senator Barrientos assumed the chair.
The chair laid out SB 1763 by Ogden, relating to vehicle
weights, which had been left pending at a previous hearing.
Senator Ogden moved that a committee substitute sent up and
adopted at a previous hearing be withdrawn; without objection,
it was so ordered. Senator Ogden sent up a committee
substitute; the chair recognized Senator Ogden to explain the
difference between the committee substitute and the bill as
filed. Senator Ogden moved adoption of the committee
substitute; without objection, it was so ordered. Senator Ogden
moved that SB 1763 do not pass but that CSSB 1763 be reported
back to the Senate with the recommendation that it do pass and
be printed. The motion carried with a record vote of 8 ayes, 0
nay, 0 present not voting, and 1 absent.
At 2:21 p.m. Senator Ogden resumed the chair.
The chair laid out HB 9 by Flores/Shapiro, relating to homeland
security, which had been left pending at a previous hearing.
Senator Wentworth sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted. Senator
Shapleigh sent up Committee Amendment 2 and moved adoption;
without objection, the amendment was adopted. Senator Shapleigh
sent up Committee Amendment 3 and moved adoption; without
objection, the amendment was adopted. Senator Shapiro moved
that a committee substitute adopted at a previous hearing, and
Committee Amendment 1, Committee Amendment 2, and Committee
Amendment 3 be rolled together to create a new committee
substitute; without objection it was so ordered. Senator
Shapiro moved adoption of the committee substitute; without
objection, it was so ordered. Senator Shapiro moved that HB 9
do not pass but that CSHB 9 be reported back to the Senate with
the recommendation that it do pass and be printed. The motion
carried with a record vote of 9 ayes, 0 nay, 0 present not
voting, and 0 absent.
The chair laid out HB 11 by Keel/Shapiro, relating to the
offense of terroristic threat and to the punishment as a capital
offense of murder occurring during the commission or attempted
commission of terroristic threat, which had been left pending
at a previous hearing. Senator Ellis sent up Committee
Amendment 1 and moved adoption; without objection, the amendment
was adopted. Senator Shapiro moved that a committee substitute
adopted at a previous hearing, and Committee Amendment 1 be
rolled together to create a new committee substitute; without
objection, it was so ordered. Senator Shapiro moved adoption of
the committee substitute; without objection, it was so ordered.

reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of 9
ayes, 0 nay, 0 present not voting, and 0 absent.
The following bills had no action taken in committee: HB 479 by
Hunter/Armbrister and HB 1191 by Allen/Wentworth.
There being no further business, at 2:34 p.m. Senator Ogden
moved that the Committee stand recessed subject to the call of
the chair. Without objection, it was so ordered.
