MINUTES Thursday, May 15, 2003 9:00 a.m. Capitol Extension Auditorium ***** Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Infrastructure Development and Security Committee was held on Thursday, May 15, 2003, in the Capitol Extension Auditorium at Austin, Texas. ***** MEMBERS PRESENT: MEMBERS ABSENT: Senator Steve Ogden Senator Frank Madla Senator Gonzalo Barrientos Senator Florence Shapiro Senator Bob Deuell Senator Rodney Ellis Senator Jon Lindsay Senator Eliot Shapleigh Senator Jeff Wentworth ***** The chair called the meeting to order at 9:00 a.m. The following business was transacted: Senator Ogden moved that the committee stand recessed until 9:30 a.m.; without objection, it was so ordered. The chair reconvened the hearing at 9:31 a.m. The chair laid out HB 2006, relating to the construction and maintenance of utility, common carrier, and energy transporter facilities along, over, under, or across a railroad right-of-way, and recognized the Senate sponsor, Senator Fraser, to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list. Senator Wentworth moved adoption of the minutes from the previous hearing held on May 12, 2003; without objection, it was so ordered. Senator Ogden moved that the committee stand recessed until 30 minutes after Senate session adjournment; without objection, it was so ordered. The chair reconvened the hearing at 2:13 p.m. The chair laid out HB 3184, relating to the financing, construction, improvement, maintenance, and operation of toll facilities by the Texas Department of Transportation, and recognized the Senate sponsor, Senator Barrientos, to explain the bill. Senator Barrientos sent up a committee substitute; the chair recognized Senator Barrientos to explain the difference between the committee substitute and the bill as filed. Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Ogden moved that HB 3184 be left pending to await a quorum; without objection, it was so ordered. Public testimony on HB 2006 resumed. The chair laid out HB 3184, which had been left pending earlier in the hearing. Senator Barrientos moved adoption of a committee substitute sent up earlier at the hearing; without objection, it was so ordered. Upon arrival of a quorum, Senator Barrientos moved that HB 3184 do not pass but that CSHB 3184 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent. Public testimony on HB 2006 resumed. At 3:19 p.m. Senator Barrientos assumed the chair. At 3:26 p.m. Senator Ogden resumed the chair. The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Ogden moved that HB 2006 be left pending; without objection, it was so ordered. The following bill had no action taken in committee: SB 1677 by Barrientos. There being no further business, at 3:35 p.m. Senator Ogden moved that the Committee stand recessed subject to the call of the chair.
