         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Infrastructure Development  
         and Security Committee was held on Wednesday, May 21, 2003, in  
         the Capitol Extension, Room E1.016, at Austin, Texas.

         The chair called the meeting to order at 8:35 a.m.  There being  
         a quorum present, the following business was transacted:   
          
         Senator Ogden moved that Articles 5, 7, and 12 of HB 3588 be  
         referred to the Special Select Subcommittee for further  
         consideration; without objection, it was so ordered. 
          
         Senator Ogden moved that the committee stand recessed for 5  
         minutes; without objection, it was so ordered. 
          
         The chair reconvened the hearing at 8:39 a.m. 
          
         The chair laid out HB 814, relating to motor vehicle financial  
         responsibility; providing penalties, and recognized Senator  
         Bivins.  Senator Ogden sent up a committee substitute; the chair  
         recognized Senator Bivins to explain the difference between the  
         committee substitute and the bill as filed.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list. 
          
         At 9:11 a.m. Senator Barrientos assumed the chair.  Public  
         testimony continued. 
         At 9:34 a.m. Senator Wentworth assumed the chair.   
          
         The chair recognized Senator Barrientos to lay out HB 814, as  
  
         engrossed.  Public testimony continued. 
          
         At 10:00 a.m. Senator Ogden resumed the chair.   
          
         Senator Ogden moved that HB 814 be left pending awaiting further  
         testimony; without objection, it was so ordered. 
          
         The chair laid out HB 3185, relating to the formula program for  
         distribution of state grants to public transportation providers,  
         and recognized the Senate sponsor, Senator Staples, to explain  
         the bill.  Senator Wentworth sent up Committee Amendment 1. The  
         chair moved that the bill be left pending awaiting public  
         testimony; without objection, it was so ordered. 
          
         The chair laid out HJR 28, proposing a constitutional amendment  
         providing for authorization of the issuing of notes or the  
         borrowing of money on a short-term basis by a state  
         transportation agency for transportation-related projects, and  
         recognized the Senate sponsor, Senator Lucio, Jr., to explain  
         the bill.  The chair moved that the bill be left pending  
         awaiting public testimony; without objection, it was so ordered. 
          
         The chair laid out HB 471, relating to the borrowing of money  
         and the issuance of notes by the Texas Transportation  
         Commission; making an appropriation, and recognized the Senate  
         sponsor, Senator Lucio, Jr., to explain the bill.  The chair  
         moved that the bill be left pending awaiting public testimony;  
         without objection, it was so ordered. 
          
         At 10:14 a.m. Senator Barrientos assumed the chair. 
          
         The chair laid out HB 2377, relating to the transfer of property  
         under the jurisdiction of the Texas Department of  
         Transportation, and recognized the Senate sponsor, Senator  
         Ogden, to explain the bill.  The chair moved that the bill be  
         left pending awaiting public testimony; without objection, it  
         was so ordered. 
          
         The chair laid out HB 3343, relating to the coordination of  
         statewide public transportation by the Texas Transportation  
         Commission and the Texas Department of Transportation, and  
         recognized the Senate sponsor, Senator Ogden, to explain the  
         bill.  Senator Wentworth sent up Committee Amendment 1.

         highway, road, and street contractors, and recognized the Senate

         substitute and the bill as filed.  Senator Ogden moved adoption

         issued by the Texas                        Department of

         The chair laid out HB 3330, relating to the definition of an  
         eligible highway for purposes of applying to erect an

         an access aisle designed to aid persons with disabilities, and  
         recognized Senator Barrientos, in the absence of the Senate
