Pursuant to suspension of Senate Rule 11.18, a public hearing of
the Senate Infrastructure Development and Security Committee was
held on Thursday, May 22, 2003, in the Sam Houston Building 210.

The chair called the meeting to order at 8:30 a.m. There being
a quorum present, the following business was transacted:
The chair laid out HB 3588, which had been left pending at a
previous hearing, relating to the construction, acquisition,
financing, maintenance, management, operation, ownership, and
control of transportation facilities and the progress,
improvement, policing, and safety of transportation in the
state. Witnesses testifying and registering on the bill are
shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Ogden moved that HB 3588 be left pending; without
objection, it was so ordered.
At 9:00 a.m. Senator Ogden moved that the committee stand
recessed until 10:00 a.m; without objection, it was so ordered.
Senator Ogden reconvened the hearing at 10:02 a.m.
The chair laid out HB 479, which had been left pending at a
previous hearing, relating to registration with the Selective
Service System of certain applicants for a driver's license or
personal identification certificate. Senator Shapleigh sent up
Committee Amendment 1 and moved adoption; without objection, the
amendment was adopted. Senator Ogden requested unanimous
consent to roll the amendment into a committee substitute;
without objection, it was so ordered. Senator Shapleigh then
moved that the committee substitute be adopted; without
objection, it was so ordered. Senator Shapleigh moved that HB
479 do not pass but that CSHB 479 be reported back to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a record vote of 6 ayes, 0 nay, 0 present
not voting, and 3 absent. Senator Shapleigh moved that the bill
be recommended for placement on the Local & Uncontested
Calendar; without objection, it was so ordered.
The chair laid out HB 1699, which had been left pending at a
previous hearing, relating to the liability of certain highway,
road, and street contractors. Senator Ogden moved to pull down
a committee substitute sent up and adopted at a previous
hearing; without objection, it was so ordered. Senator
Shapleigh moved that HB 1699 be reported favorably to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a record vote of 7 ayes, 0 nay, 0 present
not voting, and 2 absent.

previous hearing, relating to an offense of blocking an access
aisle designed to aid persons with disabilities. Senator Deuell
moved that HB 1784 be reported favorably to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 7 ayes, 0 nay, 0 present not
voting, and 2 absent. Senator Deuell moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The chair laid out HB 2006, which had been left pending at a
previous hearing, relating to the construction and maintenance
of utility, common carrier, and energy transporter facilities
along, over, under, or across a railroad right-of-way. Senator
Shapleigh sent up a committee substitute; the chair recognized
Senator Shapleigh to explain the difference between the
committee substitute and the bill as filed. Senator Shapleigh
moved adoption of the committee substitute; without objection,
it was so ordered. Senator Ogden moved that HB 2006 be left
pending; without objection, it was so ordered.
At 10:15 a.m. Senator Madla assumed the chair.
The chair laid out HB 2377, which had been left pending at a
previous hearing, relating to the transfer of property under the
jurisdiction of the Texas Department of Transportation. Senator
Ogden moved that HB 2377 be reported favorably to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a record vote of 7 ayes, 0 nay, 0 present
not voting, and 2 absent.
At 10:16 a.m. Senator Ogden resumed the chair.
The chair laid out HB 2500, which had been left pending at a
previous hearing, relating to the enforcement of fares imposed
for the use of certain public transportation systems; providing
penalties. Senator Ogden moved to roll a committee substitute
and Committee Amendment 1, both of which had been sent up at a
previous hearing, into a new committee substitute and moved its
adoption; without objection, it was so ordered. Senator Deuell
moved that HB 2500 do not pass but that CSHB 2500 be reported
back to the Senate with the recommendation that it do pass and
be printed. The motion carried with a record vote of 7 ayes, 0
nay, 0 present not voting, and 2 absent. Senator Ogden moved
that the bill be recommended for placement on the Local &
Uncontested Calendar; without objection, it was so ordered.

previous hearing, relating to the creation of a council to
oversee the implementation of a statewide integrated public
safety radio communications system for public safety and
homeland security purposes. Senator Shapleigh moved that HB 2650

previous hearing, relating to the definition of an eligible
highway for purposes of applying to erect an information logo
sign. Senator Lindsay sent up a committee substitute; the chair
recognized Senator Lindsay to explain the difference between the
committee substitute and the bill as filed. Senator Lindsay
moved adoption of the committee substitute; without objection,
it was so ordered. Senator Lindsay moved that HB 3330 do not
pass but that CSHB 3330 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 7 ayes, 0 nay, 0 present not
voting, and 2 absent.
The following bills had no action taken in committee: HB 471 by
Lucio, HJR 28 by Lucio, HB 814 by Barrientos, HB 3185 by
Staples, and HB 3343 by Ogden.
There being no further business, at 10:20 a.m. Senator Ogden
moved that the Committee stand recessed subject to the call of
