MINUTES Wednesday, July 9, 2003 10:00 a.m. Capitol Extension, Room E1.028 and Senator Ogden's Desk, Senate Chamber ***** Pursuant to suspension of Senate Rule 11.18, a public hearing of the Infrastructure Development and Security Committee was held on Wednesday, July 9, 2003, in the Capitol Extension, Room E1.028, at Austin, Texas, and the afternoon portion in the Senate Chamber, at Senator Ogden's desk. ***** MEMBERS PRESENT: MEMBERS ABSENT: Senator Steve Ogden Senator Gonzalo Barrientos Senator Bob Deuell Senator Rodney Ellis Senator Jon Lindsay Senator Frank Madla Senator Florence Shapiro Senator Eliot Shapleigh Senator Jeff Wentworth ***** The chair called the meeting to order at 10:04 a.m. The following business was transacted: The chair moved that the committee stand at ease until 11:00 a.m., pending the arrival of a committee substitute; without objection, it was so ordered. The committee reconvened at 11:02 a.m. At 11:03 a.m. Senator Wentworth assumed the chair. The chair laid out SB 21, relating to the financing, construction, improvement, maintenance, and operation of toll facilities by the Texas Department of Transportation and the disposition of money generated by the driver responsibility program, additional court costs imposed on conviction of certain traffic offenses, and certain fees collected by the Department of Public Safety, and recognized the author, Senator Ogden, to explain the bill. Senator Ogden sent up a committee substitute; the chair recognized Senator Ogden to explain the difference between the committee substitute and the bill as filed. Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Wentworth moved that SB 21 be left pending; without objection, it was so ordered. At 11:30 a.m. Senator Ogden resumed the chair. At 11:31 a.m. Senator Ogden moved that the committee stand recessed until Senate session adjournment, whereupon the committee would meet at his desk to vote on SB 21; without objection, it was so ordered. Pursuant to suspension of Senate Rule 11.18, the committee reconvened at Senator Ogden's desk at 1:24 p.m. At 1:25 p.m. Senator Shapiro assumed the chair. The chair laid out SB 21 by Ogden, which had been left pending earlier in the hearing. Senator Ogden moved adoption of a committee substitute sent up earlier at the hearing; without objection, it was so ordered. Senator Lindsay sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. Senator Ogden moved that Committee Amendment 1 and the committee substitute be rolled together to create a new committee substitute; without objection, it was so ordered. Senator Ogden moved that SB 21 do not pass but that CSSB 21 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent. At 1:39 p.m. Senator Ogden resumed the chair. There being no further business, at 1:41 p.m. Senator Ogden moved that the Committee stand recessed subject to the call of the chair.
