Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Infrastructure Development
and Security was held on Wednesday, July 16, 2003, in the
Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 9:04 a.m. There being
a quorum present, the following business was transacted:
The chair laid out SB 44, relating to the use of the Texas
Online project in connection with the purchasing of motor
vehicle inspection certificates and the sending of inspection
records, reports, and information to the Department of Public
Safety, and recognized the author, Senator Shapleigh, to explain
the bill. Senator Shapleigh sent up a committee substitute; the
chair recognized Senator Shapleigh to explain the difference
between the committee substitute and the bill as filed.
Witnesses testifying and registering on the bill are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered. Senator Ogden
moved that SB 44 be left pending; without objection, it was so
ordered.
The chair laid out SB 47, relating to requiring the Texas
Department of Transportation to annually report to the
legislature on certain transportation matters, and recognized
the author, Senator Shapleigh, to explain the bill. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered. Senator Ogden moved that
SB 47 be left pending; without objection, it was so ordered.
At 9:15 a.m. Senator Wentworth assumed the chair.
The chair laid out SB 43, relating to motor vehicle registration
fees, and recognized the author, Senator Ogden, to explain the
bill. Witnesses testifying and registering on the bill are shown
on the attached list. The chair moved that the public testimony
be closed; without objection, it was so ordered. Senator
Wentworth moved that SB 43 be left pending; without objection,
it was so ordered.
The chair laid out SB 51, relating to appropriating certain
surcharges collected by the Department of Public Safety under
the driver responsibility program and fees collected by the
Texas Department of Transportation under the motor vehicle
financial responsibility verification program, as those programs
are created by House Bill No. 3588, Acts of the 78th
Legislature, Regular Session, 2003, to the Department of Public
Safety, and recognized the author, Senator Ogden, to explain the
bill. Senator Wentworth moved that SB 51 be left pending;
without objection, it was so ordered.
The chair laid out SB 52, relating to the expenditure of funds
on rail facilites by the Texas Department of Transportation, and
recognized the author, Senator Ogden, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered. Senator Wentworth
moved that SB 52 be left pending; without objection, it was so
ordered.
The chair laid out SB 53, relating to the financing and
development of the Trans-Texas Corridor, and recognized the
author, Senator Ogden, to explain the bill. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered. Senator Wentworth moved
that SB 53 be left pending; without objection, it was so
ordered.
The chair laid out SB 43 by Ogden, which had been left pending
earlier in the hearing. Senator Ogden moved that SB 43 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 7 ayes, 0 nay, 0 present not voting, and 2 absent.

earlier in the hearing. Senator Ogden moved that SB 51 be reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried

The chair laid out SB 53, which had been left pending earlier in the hearing. Senator Ogden moved that SB 53
be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion
carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.

The chair laid out SB 44 by Shapleigh, which had been left pending earlier in the hearing. Senator Shapleigh
moved adoption of a committee substitute sent up earlier in the hearing; without objection, it was so ordered.
Senator Shapleigh moved that SB 44 do not pass but that CSSB 44 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nay, 0
present not voting, and 2 absent.
The chair laid out SB 47 by Shapleigh, which had been left pending earlier in the hearing. Senator Shapleigh
moved that SB 47 be reported favorably to the Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.
There being no further business, at 9:58 a.m. Senator Ogden moved that the Committee stand recessed
subject to the call of the chair. Without objection, it was so ordered.
