         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on  
         Infrastructure Development and Security was held on Tuesday, May  
         4, 2004, in the Senate Chamber at Austin, Texas.

         A joint hearing of the Senate Infrastructure Development and  
         Security Committee and the House Transportation Committee was  
         held.  Chairmen Staples and Krusee shared presiding duties. 
          
         Chairman Staples called the Senate Infrastructure Development  
         and Security Committee  to order at 8:32 a.m.  Chairman Krusee  
         called the House Transportation Committee to order at 8:32 a.m. 
          
         At 8:34 a.m. Chairman Staples laid out Senate Infrastructure  
         Development and Security Committee Charges 1, 3 & 4 jointly.   
         Chairman Krusse laid out House Transportation Committee Charge #  
         3.  Invited testimony began.  Witnesses registering and/or  
         testifying are shown on the attached list. 
          
         At 8:53 a.m. roll was called.  With a quorum being present  
         invited testimony resumed. 
          
         Senator Madla present at 8:57 a.m. 
          
         At 9:40 a.m. Senator Barrientos assumed the chair.   
          
         At 9:45 p.m. Chairman Staples resumed the chair.   
          
         Chairman Staples announced a short recess at 10:18 a.m. to let  
         the house committee adjourn for session.  Chairman Krusee announced 
	 recess for the House Transportation Committee at 10:19 a.m. to  
         reconvene subject to the call of  
         the Chair. 
          
         At 10:32 a.m. the Senate Infrastructure Development and Security  
         Committee reconvened. 
          
         Invited testimony resumed. 
          
         At 12:21 p.m. a short recess for lunch was announced to reconvene at
	 12:45 p.m. 
          
         The Committee reconvened at 12:45 p.m. 
          
         Invited testimony resumed. 
          
         After all invited testimony was heard the Chairman left Committee 
	 Charges 1, 3 & 4 open.   
          
         At 1:39 p.m. the Chairman recessed the hearing until Wednesday, May 5, 2004
	 at 8:30 a.m. in E1.028 where invited testimony on Senate Committee on 
	 Infrastructure Development and Security Interim Charges 2 and 5 will be taken.
