Amend CSHB 3 as follows:                                                     



(1)  Strike SECTION 3A.05 of the bill, amending Section 	151.315, Tax Code, and renumber subsequent SECTIONS of the bill 

accordingly.

	(2)  Add the following appropriately numbered ARTICLE to the 

bill and renumber subsequent ARTICLES of the bill accordingly:



ARTICLE __.  TAXES ON ALCOHOL

	SECTION ___.01.  Section 203.01, Alcoholic Beverage Code, is 

amended to read as follows:

	Sec. 203.01.  TAX ON BEER.  A tax is imposed on the first sale 

of beer manufactured in this state or imported into this state at 

the rate of $11 [six dollars] per barrel.

	SECTION ___.02.  This article takes effect September 1, 

2005, if this Act receives a vote of two-thirds of all the members 

elected to each house, as provided by Section 39, Article III, Texas 

Constitution.  If this Act does not receive the vote necessary for 

effect on that date, this article takes effect November 1, 2005.
