Amend SB 21 (house committee printing) by adding the
following appropriately numbered SECTION to the bill and
renumbering subsequent SECTIONS of the bill as appropriate:
SECTION __. Chapter 64, Utilities Code, is amended by
adding Subchapter F to read as follows:
SUBCHAPTER F. TRUTH IN TELECOMMUNICATIONS BILLING
Sec. 64.251. DEFINITION. In this subchapter, "commercial
mobile service provider" means a provider of commercial mobile
service as defined by Section 332(d), Communications Act of 1934
(47 U.S.C. Section 151 et seq.), Federal Communications Commission
rules, and the Omnibus Budget Reconciliation Act of 1993 (Pub. L.
No. 103-66).
Sec. 64.252. BILLING STATEMENT. (a) A commercial mobile
service provider or a telecommunications provider may include only
the following in a customer's bill:
(1) applicable charges for service and options
requested by the customer; and
(2) taxes imposed by a governmental entity
specifically on the customer.
(b) A customer's bill may not contain a fee, charge, or tax
unless state or federal law:
(1) requires the customer to pay the fee, charge, or
tax; or
(2) authorizes a commercial mobile service provider or
a telecommunications provider to include the fee, charge, or tax in
a customer's bill.
(c) A violation of this section is a false, misleading, or
deceptive act or practice within the meaning of Section 17.46,
Business & Commerce Code, and is actionable in a public suit brought
under Subchapter E, Chapter 17, Business & Commerce Code.
