BACKGROUND AND PURPOSE

 

The Governor vetoed various appropriations in Senate Bill 1, 79th Legislature, Regular Session, including amounts appropriated for the Texas Education Agency (TEA).  This bill provides an appropriation for TEA for the support of public schools for the 2006-07 biennium and also makes other provisions in order to conform with Senate Bill 1, 79th Legislature, Regular Session.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

Committee Substitute House Bill 1 sets forth appropriations for TEA for the 2006-07 biennium.  The bill specifies the distribution of these appropriations among different budget strategies and methods of finance.

 

Committee Substitute House Bill 1 directs the Legislative Budget Board (LBB) to make any necessary adjustments to these appropriations, as well as rider provisions set forth in Senate Bill 1, 79th Legislature, Regular Session, in order to delineate appropriation authority and expenditure requirements for TEA. 

 

Committee Substitute House Bill 1 reduces appropriations made in Article IX, Section 13.18, of Senate Bill 1, 79th Legislature, Regular Session, by the amount of appropriations made in this bill from the same fund sources.

 

Committee Substitute House Bill 1 makes an appropriation for implementation of House Bill 2 (or similar legislation) by the current Legislature, contingent upon enactment of both House Bill 2 (or similar legislation) and House Bill 3 (or similar legislation) by the current Legislature.  The bill directs the LBB to make all necessary adjustments to public education strategies, methods of finance, measures, and rider provisions for such implementation.  The bill also directs TEA to develop an implementation plan.

 

 

EFFECTIVE DATE

 

This Act takes effect upon passage, or, if the Act does not receive the necessary vote, the Act takes effect on the 91st day after the last day of the legislative session.

 

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

Committee Substitute House Bill 1 adds provisions relating to a contingency appropriation that is contingent upon the enactment of House Bill 2 (or similar legislation) and House Bill 3 (or similar legislation) by the current Legislature.
