AUTHOR'S/SPONSOR'S STATEMENT OF INTENT
Municipal management districts are tools for municipalities to use to address problems and issues in commercial areas.
As proposed, S.B. 77 authorizes certain small municipalities to create municipal management districts operating pursuant to Chapter 375, Local Government Code. It applies only to a home-rule municipality with a population of 5,000 or less that is located in a county with a population of 3.3 million or more.

SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subtitle A, Title 12, Local Government Code, by adding Chapter 375A, as follows:
CHAPTER 375A. MUNICIPAL MANAGEMENT DISTRICTS IN CERTAIN SMALL
MUNICIPALITIES
Sets forth standard language for the creation of a municipal management district in a home-rule municipality with certain population requirements. Sets forth standards, procedures, requirements, and criteria for:
Creation, approval, purpose, inclusion of special zones, applicability of law, of the district (Sections 375A.001 -375A.006);
Size composition, election, qualifications, procedures, and terms of the board of directors of the district (Sections 375A.051-375A.057);
Powers and duties of the district (Sections 375A.101-3852.109);
General finance provisions and authority to issue bonds and obligations for the district (Sections 375A.151-375A.160);
Sales and Use Tax (Sections 375A.201-375A.205); and
Dissolution of district (Sections 375A.251).
Prohibits the use of eminent domain by the district (Section 375A.109).
SECTION 2. Effective date: upon passage or the 91st day after adjournment.
