AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

S.B. 79 creates the Bee Cave Development District in order to promote and encourage economic growth and development and public welfare in the Village of Bee Cave. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3840, as follows:

 

CHAPTER 3840.  BEE CAVE DEVELOPMENT  DISTRICT     

 

Sets forth standard language for the creation of the Bee Cave Development District (district) in Travis County and the Village of Bee Cave.  Sets forth standards, procedures, requirements, and criteria for:

 

Creation, approval, purpose, inclusion of special zones, and applicability of law of the district (Sections 3840.001-3840.008);

 

Size composition, election, qualifications, procedures, and terms of the board of directors of the district (Sections 3840.051-3840.054);

 

Powers and duties of the district (Sections 3840.101-3840.106);

 

Financial provisions and authority to issue bonds and obligations for the district (Sections 3840.151-3840.162); and

 

Dissolution of district procedures and enforcement of powers (Sections 3840.201 and 3840.251). 

 

Prohibits the use of eminent domain by the district (Section 3840.105). 

 

SECTION 2.  Sets forth the initial boundaries of the district.   

 

SECTION 3.  Requires the governing body, not later than January 1, 2006, to appoint the initial board of directors for the district under Section 3840.052, Special District Local Laws Code, as added by this Act.  Requires the governing body to stagger the initial directors' terms so that three terms expire July 1, 2007, and two terms expire July 1, 2009. 

 

SECTION 4.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished. 

 

SECTION 5.  Effective date: upon passage or September 1, 2005.
