HB73 by Pena (Relating to the use of the power of eminent domain by a political subdivision.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to prohibit the taking of private property by a political subdivision of this state through the use of eminent domain if the taking is primarily for economic development purposes unless the area being developed is a blighted area or slum area.

 

The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect on the 91st day after the last day of the legislative session. Provisions of the bill would apply only to the taking of property for which a condemnation petition is filed on or after the effective date.

The fiscal impact to units of local government cannot be determined.
