LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATURE 1st CALLED SESSION - 2005

July 12, 2005

TO:
Honorable Anna Mowery, Chair, House Committee on Land & Resource Management

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB84 by Coleman (Relating to the exercise of eminent domain authority or purchase of certain real property by certain nonprofit charitable corporations.), As Introduced

No fiscal implication to the State is anticipated.

The bill would add to the requirements that certain nonprofit charitable corporations must follow to exercise eminent domain or to purchase certain real property. The proposed requirements would apply only to the acquisition of real property by eminent domain or the purchase of real property on or after the effective date of the bill unless the proceedings are begun before the effective date.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect the 91st day after the last day of the legislative session.

Because nonprofit charitable corporations are not government entities and land used for public purposes is exempt from paying property taxes, there would be no fiscal impact to state or local government.

Local Government Impact

No fiscal implication to units of local government is anticipated.
