OPEN GOVERNMENT IMPACT STATEMENT

79TH LEGISLATURE 1st CALLED SESSION - 2005

July 9, 2005

TO:
Honorable Steve Ogden, Chair, Senate Committee on Finance

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB3 by Keffer, Jim (Relating to property tax relief and protection of taxpayers, certain taxes, fees, and property, and other matters relating to the financing of public schools; providing civil and criminal penalties; making an appropriation.), As Engrossed

As a result of this bill there will be a restriction upon:

(1) the open meetings law.

This bill would amend the Tax Code to create a statutory exception to open meetings law which would close to the public any confidential information disclosed pursuant to Section 22.27 Subsection (b) of the Tax Code, unless all parties consent to public access. Because this bill would create an exception to open meetings law, a restriction to existing open meetings law is anticipated.
