Amend CSSB 7 by adding the following appropriately numbered 

SECTION to the bill and renumbering the other SECTIONS of the bill 

accordingly:

	SECTION ___.  Subchapter Z, Chapter 51, Education Code, is 

amended by adding Section 51.9045 to read as follows:

	Sec. 51.9045.  LIMITATION ON USE OF EMINENT DOMAIN.  (a)  In 

this section:

		(1)  "Institution of higher education" has the meaning 

assigned by Section 61.003.

		(2)  "Lodging facility" does not include a dormitory or 

other student housing facility.

	(b)  the governing board of an institution of higher 

education may not use the power of eminent domain to acquire land to 

be used for a lodging facility or for parking or a parking structure 

intended to be used in connection with the use of a lodging 

facility.
