SENATE JOINT RESOLUTION
proposing a constitutional amendment to Section 24, Article VIII,
Texas Constitution, clarifying that a tax imposed on a business
entity other than a sole proprietorship is not a personal income
tax.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 24, Article VIII, Texas Constitution, is
amended by adding Subsection (k) to read as follows:
(k) Notwithstanding any other provision of this section,
this section does not apply to a business entity other than a sole
proprietorship.
SECTION 2. This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 8, 2005.
The ballot shall be printed to permit voting for or against the
proposition: "The constitutional amendment to Section 24, Article
VIII, Texas Constitution, clarifying that a tax imposed on a
business entity other than a sole proprietorship is not a personal
income tax."
