A BILL TO BE ENTITLED
AN ACT
relating to the authority of members of the board of trustees of an independent school district to obtain student information. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter D, Chapter 11, Education Code, is amended by adding Section 11.170 to read as follows: Sec. 11.170. BOARD MEMBER ACCESS TO INDIVIDUAL STUDENT INFORMATION. (a) Except as provided by other state or federal law and by Subsection (b), or unless the parent of the student consents in writing, a member of the board of trustees of an independent school district may not obtain school district information regarding an individual student. (b) The board of trustees of a school district may adopt a policy providing for the access to school district information regarding an individual student by the board or a designated subcommittee of the board for a specific educational purpose. The policy must specify the exact circumstances under which information may be obtained. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect on the 91st day after the last day of the legislative session.
