A BILL TO BE ENTITLED
AN ACT
relating to an appropriation to the Department of Aging and Disability Services for funding an increased personal needs allowance for certain residents of nursing or intermediate care facilities. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. In addition to amounts previously appropriated for the state fiscal biennium ending August 31, 2007, the following amounts are appropriated to the Department of Aging and Disability Services for the state fiscal year ending August 31, 2007, for the purpose of funding the personal needs allowance of eligible residents of nursing facilities or intermediate care facilities for the mentally retarded (ICF/MR) at an amount increased to $60 per month from $45 per month for each resident: (1) the amount of $10,700,000 out of the general revenue fund; and (2) the amount of $10,700,000 from federal matching funds. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect on the 91st day after the last day of the legislative session.
