A BILL TO BE ENTITLED

AN ACT

relating to adjusting the "price to beat" for electric utility 
services to reflect reduced natural gas fuel prices.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 39.202, Utilities Code, is amended by 
adding Subsection (q) to read as follows:
	(q)  The commission by order shall adjust each affiliated 
retail electric provider's fuel factor established under 
Subsection (b) to reflect reductions in the market price of natural 
gas that have occurred since the last date on which the provider's 
fuel factor was adjusted under Subsection (l).  The commission may 
adjust the fuel factors as provided by this section on its own 
motion and shall review the fuel factors for adjustment on 
complaint of an affected person.
	SECTION 2.  (a)  The Public Utilities Commission of Texas 
shall issue an order adjusting each affiliated retail electric 
provider's fuel factor as provided by this Act as soon after the 
effective date of this Act as is practicable.
	(b)  This Act takes effect immediately if it receives a vote 
of two-thirds of all the members elected to each house, as provided 
by Section 39, Article III, Texas Constitution.  If this Act does 
not receive the vote necessary for immediate effect, this Act takes 
effect September 1, 2006.
