Amend CSHB 789 as follows:                                                   

(1)  on page 29, strike line 1 and substitute:
	SECTION 32.  Section 54.202, Utilities Code, is amended by 
amending Subsection (a) and adding Subsection (c)
	(2)  on page 29, between lines 13 and 14, insert:                              
	(c)  Subsection (a) does not prevent a municipally owned 
utility from:
		(1)  providing a governmental function or a service to 
its customers that is enabled, enhanced, delivered to, or available 
to the public using the Internet, including:
			(A)  bill paying services;                                            
			(B)  emergency services;                                              
			(C)  constituent services;                                            
			(D)  utility meter reading; and                                       
			(E)  permitting; and                                                  
		(2)  providing access to its transmission and 
distribution facilities under a contract with another entity that 
allows the entity to offer to the entity's customers high speed data 
services using broadband over power line technology.
