	Amend CSHB 823 as follows:                                                   

(1)  On page 1, line 11, strike "and".
	(2)  On page 1, line 13, strike the period and substitute "; 
and".    
	(3)  On page 1, between lines 13 and 14, insert:                               
		(4)  not a member of a criminal street gang, as defined 
by Section 71.01.
