Amend CSHB 867 (House Committee Printing) as follows:
(1) On page 6, strike lines 24-26 and substitute the following:
Art. 62.002. APPLICABILITY OF CHAPTER. (a) On or after
September 1, 2005, a person, as a result of a reportable conviction
or adjudication, has a duty to register under this chapter only if
the person:
(1) had a duty to register:
(A) under this chapter at the time the person was
convicted, received a grant of deferred adjudication, or was found
to have engaged in delinquent conduct under the laws of this state
as described by this chapter; or
(B) under the laws of another state, federal law,
the laws of a foreign country, or the Uniform Code of Military
Justice as a result of a conviction or adjudication of delinquent
conduct under the laws of that jurisdiction or code, if the duty
arose at the time the person was convicted or was found to have
engaged in the delinquent conduct; or
(2) would have had a duty to register under this
chapter at the time the person was convicted or was found to have
engaged in delinquent conduct under the laws of another state,
federal law, the laws of a foreign country, or the Uniform Code of
Military Justice because the offense for which the person was
convicted, or the offense based on which the person was found to
have engaged in delinquent conduct, contains elements that are
substantially similar to the elements of an offense requiring
registration under this chapter.
(b) Subsection (a) does not affect:
(1) the authority of a court, the Board of Pardons and
Paroles, or the Texas Youth Commission to require a person to
register under this chapter as a condition of parole, release to
mandatory supervision, community supervision, or juvenile
probation; or
(2) the duties of a person who is required to register
under this chapter as a condition of parole, release to mandatory
supervision, community supervision, or juvenile probation.
(2) On page 6, line 27, strike "(b)" and substitute "(c)".
(3) On page 6, line 27, strike "Subsection (c)" and
substitute "Subsection (d)".
(4) On page 7, line 8, strike "(c)" and substitute "(d)".
(5) In ARTICLE 3 of the bill, insert the following
appropriately numbered SECTION of the bill and renumber subsequent
SECTIONS accordingly:
SECTION 3.____. The following laws are repealed:
(1) Section 11, Chapter 668, Acts of the 75th
Legislature, Regular Session, 1997; and
(2) Section 26, Chapter 1415, Acts of the 76th
Legislature, Regular Session, 1999.
