Amend HB 1294 on third reading as follows:                                   

(1)  In SECTION 1 of the bill, strike the recital and 	substitute the following:
	SECTION 1.  Section 51.014, Civil Practice and Remedies 
Code, is amended by amending Subsections (d), (e), and (f) and 
adding Subsections (d-1), (g), and (h) to read as follows:
	(2)  In SECTION 1 of the bill, between added Subsection (g), 
Section 51.014, Civil Practice and Remedies Code, and SECTION 2 of 
the bill, insert the following:
	(h)  A party that appeals from an interlocutory order under 
Subsection (d) or (d-1) shall pay all of the opposing party's costs 
associated with the interlocutory appeal if the opposing party 
prevails in the appeal.
