Amend CSHB 1701 as follows:                                                  
	(1)  On page 6, line 7, strike "criminal" and substitute 
"capital".
	(2)  On page 7, line 5, between "case" and the colon, insert 
the following:  
	"or an attorney appointed as lead appellate counsel in the 
direct appeal of a death penalty case".
	(3)  On page 7, line 12, strike "criminal" and substitute 
"capital".
	(4)  On page 8, strike lines 1-5 and renumber the existing 
subdivisions of Article 26.052(d), Code of Criminal Procedure, 
accordingly.
