	Amend CSHB 1900 (House committee printing) as follows:                       
	(1)  Add the following appropriated numbered section to the 
bill and renumber the subsequent sections accordingly:
	SECTION     .  Subchapter B, Chapter 382, Health and Safety 
Code, is amended by adding Section 382.0217 to read as follows:
	Sec. 382.0217.  IMPOSITION OF FEE DUE TO EMISSIONS EVENT.  (a)  
"Emissions event" and "regulated entity" have the meanings assigned 
by Section 382.0215.
	(b)  Notwithstanding any other law, the commission may impose 
fees relating to an emissions event in the manner provided by this 
section.
	(c)  The commission shall impose on a regulated entity for 
each emissions event reported by the regulated entity under Section 
382.0215 a fee in the amount of $500 or an adjusted amount as 
provided by Subsection (d) or (e).  A fee collected by the 
commission under this subsection may be appropriated only to the 
commission for use in awarding grants to local governments for 
community-based air pollution reduction projects that reflect 
community priorities.  The fee is exempt from the application of 
Section 403.095, Government Code.
	(d)  If the commission determines that a regulated entity is 
ranked in the top 10 percent of all regulated entities in this state 
in terms of the regulated entity's emissions event history, the 
commission may reduce the amount of an emission fee that the 
commission is authorized to collect from the regulated entity under 
this chapter by not more than 50 percent.
	(e)  If the commission determines that a regulated entity is 
ranked in the bottom 20 percent of all regulated entities in this 
state in terms of the regulated entity's emissions event history, 
the commission shall increase the amount of each emission fee that 
the commission is authorized to collect from the regulated entity 
under this chapter by at least 20 percent and not more than 50 
percent.
	(2)  On page 5, line 24, between "Act," and "apply", insert 
"and Section 382.0217, Health and Safety Code, as added by this 
Act,".
