Amend CSHB 2026 as follows:                                                  
	(1)  Add the following appropriately numbered SECTION to the 
bill and renumber the other SECTIONS of the bill accordingly:
	SECTION___.  Section 42.10(e), Penal Code, is amended to read 
as follows:    
	(e)  An offense under Subdivision [(1) or] (5) of Subsection 
(a) is a Class A misdemeanor. An offense under Subdivision (1), (2), 
(3), or (4) of Subsection (a) is a state jail felony. An offense 
under Subdivision (6) of Subsection (a) is a Class C misdemeanor.
	(2)  On page 14, line 27, between "Code," and "as amended", 
insert "and Section 42.10(e), Penal Code,".
