Amend CSHB 2702 (Senate committee printing) by adding the 
following appropriately numbered SECTION to Article 2 of the bill 
and renumbering subsequent SECTIONS as appropriate:
	SECTION __.  (a) Article 45.051(f), Code of Criminal 
Procedure, is amended to read as follows:
	(f)  This article does not apply to:                                           
		(1)  an offense to which Section 542.404 or 729.004(b), 
Transportation Code, applies; or
		(2)  a violation of a state law or local ordinance 
relating to motor vehicle control, other than a parking violation,
[traffic offense] committed by a person who holds a commercial 
driver's license.
	(b)  The change in law made by this section applies only to an 
offense committed on or after September 1, 2005.
	(c)  An offense committed before September 1, 2005, is 
covered by the law in effect when the offense was committed, and the 
former law is continued in effect for that purpose.  For purposes of 
this section, an offense was committed before September 1, 2005, if 
any element of the offense was committed before that date.
