Amend CSHB 2833 (House committee printing) as follows:                       
	(1)  On page 2, after line 11, insert the following in Section 
2007.002(5):  
			"(D)  Notwithstanding any other provision in 
Chapter 2007, a taking only occurs if and to the extent the 
diminution of property value attributable to the government action 
or series of actions identified in subsection (5)(A), (B) or (C) 
exceeds the increase of value to the same property attributable to 
government actions and activities of any kind, including but not 
limited to flood and drainage control, water quality and other 
environmental regulations and protections, zoning, law enforcement 
services, parks, education services, public health services and 
regulations, utility services, and the construction and 
maintenance of public improvements including but not limited to 
roads, highways, airports, dams, school buildings, sports 
facilities and utilities."
