Amend CSHB 3434 as follows:                                                  
	(1)  In SECTION 4 of the bill (committee printing page 1, 
line 49), strike "(a)".
	(2)  In SECTION 4 of the bill (committee printing page 1, 
lines 55-60), strike Subsection (b).
	(3)  Strike SECTION 5 of the bill (committee printing page 1, 
line 61) and substitute the following:
	SECTION 5.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
