Amend CSSB 408 by adding the following section to the bill and 
renumbering existing sections accordingly:
	SECTION ___.  Section 39.151, Utilities Code, is amended by 
adding Subsection (n) to read as follows:
	(n)  If by rule the commission authorizes ERCOT to withhold 
information collected, assembled, or maintained by ERCOT from 
disclosure to a member of the public who makes a written request to 
inspect or copy the information, the commission shall require 
ERCOT, in the time and manner required of a governmental body by 
Subchapter G, Chapter 552, Government Code, to request a decision 
from the attorney general as to whether the information is 
confidential or may be withheld from public disclosure in 
accordance with an applicable state or federal law or a rule of the 
commission.  On receipt by the attorney general of a request from 
ERCOT under this subsection, the attorney general shall proceed in 
the time and manner required by Subchapter G, Chapter 552, 
Government Code, in connection with a request for an attorney 
general decision under that subchapter.
