Amend SB 645 on page 2, between lines 14 and 15, by inserting 
new Section 240.054, to read as follows:
	"Sec. 240.054.  GRANDFATHERED FACILITIES.  This subchapter 
does not apply to outdoor lighting owned and maintained by a utility 
or the use of outdoor lighting for the purpose of the operations of 
an electric utility or a power generation company or a transmission 
and distribution utility as defined by Section 31.002, Utilities 
Code, or a gas utility as defined by Section 101.003 or 121.001, 
Utilities Code, or surface coal mining and reclamation operations 
as defined by Section 134.004, Natural Resources Code, existing 
prior to September 1, 2005.
